Obelisk is owned and operated by Toadstool Labs LLC, located in Portland, Oregon. These Terms and Conditions (“Terms”) govern your use of our web application (https://obelisk.li) and API (“Obelisk platform”). By using Obelisk, you agree to these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing Obelisk, you confirm that you have the right and authority to agree to these Terms. If you do not agree, please do not use our services. We may update these Terms from time to time by posting revised versions on our website. Your continued use of Obelisk constitutes acceptance of the updated Terms.

2. Notifications

By providing your email address, you consent to receiving service updates, feature changes, and news. You may opt out of marketing communications using the unsubscribe link in our emails.

3. Registration and User Account

You may register via email or a third-party service (e.g., Google). You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at hello@obelisk.li of any unauthorized access. You may close your account by contacting us at the same email. We reserve the right to suspend or terminate any account for violations of these Terms.

4. Use of the Platform

Obelisk provides services to extract structured data from documents and to search URLs for publicly available information. You agree to use the platform only for lawful purposes and to access only data for which you have proper authorization. You are solely responsible for ensuring that any URL you request for scraping is legally accessible to you. Obelisk is not responsible for any legal consequences arising from unauthorized scraping or improper access.

5. Data Ownership and Customer Responsibility

All data submitted, stored, or processed through Obelisk remains your property. You are solely responsible for the content, accuracy, and legality of your data. Toadstool Labs LLC does not claim ownership over your data and is not liable for any issues arising from your data content or the manner in which you use or process it.

6. Pricing, Payment, and Refunds

Obelisk is priced on a "operations" basis. Upon registration, you receive 50 free operations. Additional operations may be purchased via:

All purchases are final and non-refundable except in the case of a verified billing error, which will be handled at our discretion.

7. Limitation of Liability

Obelisk is provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement. Toadstool Labs LLC is not liable for inaccuracies, data loss, or technical failures. Liability is limited to the fees paid by you in the three months preceding a claim, and no claim may be brought more than one month after the event. This limitation does not apply to damages arising from gross negligence or willful misconduct.

We grant you a non-exclusive, non-transferable, worldwide license to use Obelisk as permitted by these Terms. Unauthorized use, including reverse-engineering or modifying our software, is strictly prohibited.

All content on Obelisk is the property of Toadstool Labs LLC or its licensors. Materials provided on Obelisk are for personal, non-commercial use only. Reproduction or modification without our written consent is prohibited.

13. Changes to the Service

We may modify or discontinue Obelisk (or any part thereof) at any time. Continued use after such changes constitutes acceptance of the revised Terms.

These Terms, along with our Privacy Policy, constitute the entire agreement regarding your use of Obelisk. If any provision is held invalid, the remaining provisions will continue in full force.

Toadstool Labs LLC is not liable for any failure or delay in performance due to events beyond our reasonable control (e.g., natural disasters, government actions, or other unforeseen events).

Failure to comply with these Terms may result in immediate termination of your account. Termination does not relieve you of obligations incurred prior to termination.

17. Dispute Resolution and Arbitration

Any disputes arising from these Terms shall be resolved through binding arbitration in Portland, Oregon, under applicable commercial arbitration rules. To the extent permitted by law, you agree to waive any class action claims.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States and the State of Oregon. Any disputes not resolved through arbitration will be subject to the exclusive jurisdiction of the state or federal courts located in Oregon.

19. Final Provisions

Your use of Obelisk is subject to these Terms. We reserve all rights not expressly granted herein. Compliance with legal or governmental requests may require disclosure of information.
